EvaConsult provides no-cure no-pay consulting services to all kinds of organisations dealing with non-compliance claims from their software vendors.
A simplified example: a business produces plastic toys (PT Inc.). It has a production line and a warehouse. It employs 50 people. It uses a particular business software package which integrates all activities in the company (production scheduling, warehousing, sales, shipping, HR, etc. etc.). To use the software the company must pay the software vendor $5,000 for each person using the software. This is a called a licens fee, and is a one-time fee. All 50 employees use the software. PT Inc. currently has 50 licenses. All would appear to be in order.
Recently the software vendor has determined that although PT Inc. only has 50 employees at this time, they have 70 user names listed in the software's user name list. The reason is that PT Inc. has, over time, forgotten to purge employees which have left the company from the user list.
The vendor claims that PT Inc. is out of compliance with the license agreement that PT Inc and the vendor entered into at the start of their business relationship. The vendors' postion is that PT Inc. owes them addtional license fees of (70-50)*5,000 = $100,000.
PT Inc. feels this is unreasonable and hires an EvaConsult consultant to
support them in dealing with this matter. Any result that is below the $100,000 benchmark is considered a success. EvaConsult will receive a percentage of the difference between the claim and the result.
